Policies, Procedures, and Agreements
In-take Policies
We do not usually take animals from individuals unless under dire circumstances. We are glad to place a courtesy listing on our site and petfinder site to help the owner find the animal a home. We require the animal to be spayed or neutered before we list it.

Adoption Policies
Adopters must read and sign our adoption agreement in order to adopt an animal. Adopters must be at least 21 years of age and never have been convicted of any animal related crimes including but not limited to: cruelty, neglect, abandonment, dog or cock fighting, beastiality, etc.
Adopters must provide credible references one of which should be a veterinarian or other animal care specialist. We will not adopt any animal as a gift or surprise. All persons in the household must be accepting of the animal. If the adoption does not work out, the adopter must return the animal to When There's a Will, There's a Way.

Transporting and Shipping
When There's a Will, There's a Way has transported pets successfully via volunteer transport chains. We only transport after the adopter has been throughly checked. Adopters out of state must acknowlege that if the adoption does not work out, they are still responsible for returning the animal to When There's a Will, There's a Way even if it is at their own expense.
When There's a Will, There's a Way will ship animals via airline at the expense of the adopter. This includes but is not limited to approved airline crate/carrier, health certificate, plane ticket, and any other expense required by the airline.

We will only ship through Contintial Airlines (Birmingham, AL branch)

Adoption Agreement

Adoption Agreement, please read and sign below.

In consideration of the payment of $_________ the receipt of which is acknowledged ownership is transferred to the undersigned adopter who assumes all risk and financial responsibilities of ownership. The adopter releases When There's a WILL, There's a WAY, (herein and after referred to as WTWTW), from any liability associated with any illness of the animal or damage, accident, or injury hereafter caused by said animal. The adopter agrees that WTWTW will not in any way be held responsible for the conduct of this animal after its adoption. The adopter understands that some or all of the information provided on the Adoption Agreement regarding said animal may have been received by WTWTW from a third party. The adopter understands that WTWTW, does no warrant the accuracy of such information. If at any time, the adopter desires to relinquish custody, or WTWTW demands its release for failure to comply with this agreement, the adopter agrees to return said animal to WTWTW, making no charges of any nature for licensing, care, food, or other services or items provided by the adopter. The adopter agrees to pay any reasonable attorney fees, court expenses and liquidated damages of $1000.00 to WTWTW if legal action against the adopter must be filed to enforce this Adoption Agreement. TERMS OF ADOPTION: This Rescue exist to help the helpless and to educate about unwanted animals. We strive to do our part in the over population problem that faces Shelter's and other Rescue groups daily. Where there's a Will there's a Way Rescue is a MANDOTORY SPAY/NEUTER RESCUE. All companion animals adopted through our organization will be altered prior to adoption when age of said animal allows. If said animal is not yet of age for the alteration surgery to be preformed, the Adopter agree's to schedule surgery and transport animal on or before date listed. There will be a Spay/Neuter CERTIFICATE attached with Adoption paperwork.

1. Return: The animal may be returned to WTWTW, at any time if the adopter is not able or willing to keep the adopted animal. I will return this animal to WTWTW if I am asked to because of my violation of any term of this agreement or because of other conduct which is harmful to the animal or for misrepresentation of information on my application to adopt this animal.

2. Transfer of Ownership: The animal may not be transferred to any other person or entity for any reason. The undersigned adopter is forced to relinquish custody of the animal at anytime for any reason, said animal will be relinquished only to WTWTW. I agree that I shall never transfer ownership of this dog to an animal shelter, humane society, pound, or any other person.

3. Refund: Adopters are given one week from adoption date to determine if the adopted animal is working out. If the adopters contact WTWTW within a one week period and request the animal be returned, they shall recieve a refund in full of the adoption fee only. If after one week from the adoption date, the adopter requests to return the animal, there will be no refund of any kind. There will be no refund or reimbursement for any expenses incurred by the adopter for the above designated animal, even if returned to WTWTW. This includes no refund for adoption payment.

4. Health Problems: The dog will be cared for humanely, including adequate food, shelter, water, and veterinary care and will be licensed in accordance with the laws in the jurisdiction in which the dog resides with the adopter. The pet is to be kept as and indoor family pet and exercised in a fenced area or on a leash. The dog is not to be free to roam nor will it be tethered, restrained, or chained to any inanimate object. Monthly Heartworm preventative along with annual vaccinations (or as needed) including Rabies Vaccination by a licensed veterinarian are required.

5. Loss: If the dog is lost, or stolen, the adopter will notify WTWTW immediately.

6. ID Tag: Your pet should wear ID tags with a current name and address at all times.

7. Transportation: I agree never to allow my pet to ride unsecured in the back of a pickup truck. I agree the safest way to transport via pickup truck is within the cab of the pickup, but if this is not possible, I agree to transport my pet in a safely secured crate. When riding in a pickup truck bed, my pet will never be tethered or restrained in a way other than a secured crate.

8. Food: I agree to feed my pet a high quality food as these have been shown to help improve the life and health of pets.

9. Problem Notification: Because adjustment to a new home and family can be difficult for my pet, I will call or email WTWTW if I see any behavioral problems develop. By getting help and advice quickly, I have a better chance of deterring unwanted behaviors.

10. Reservation of Rights: WTWTW reserves the right to enforce this contract in order to protect the welfare of the dog. It is understood that WTWTW, may examine and may make inquiry about said animal at any time. IF the terms and conditions of this agreement are not upheld, WTWTW reserves the right to enforce this agreement and to reclaim the animal.

11. Liability: I have discussed the known medical status of this animal and understand that all future veterinary expenses will be my responsibility. I will indemnify and hold WTWTW harmless for any damage which this dog may do to any person or property.

I have completly read and understand the Adoption Agreement and if there is any part that I do not understand, I have had the opportunity to talk with a WTWTW Representative about them. I also acknowledge that I am at least 21 years of age and at this time and I am able to meet all the needs of my new pet listed above.
